Terms and Conditions TOHUMAN APP

General

By downloading or using the TOHUMAN LifeWave app – hereafter also referred to as “the app”, “this app”, and “the TOHUMAN app” – these terms and conditions are automatically in effect. Read them carefully before using the app. We are offering you this app to use for your own personal use, and you should be aware that you cannot send it on to anyone else, and you are not allowed in any way to copy or modify the app or any part of the app. You are not allowed to attempt to extract the source code of the app, and translation of the app or parts thereof, or making derivative apps is also prohibited. The app itself and all the trademarks, designs and interfaces, copyright, database rights and other intellectual property rights related to the app and TOHUMAN Ltd is the sole property of TOHUMAN.

Use of the TOHUMAN LifeWave app

The functions of the app will all require the mobile device to have an active internet connection.

If you are using the app outside of an area with Wi-Fi, you should remember that your terms of agreement with your mobile network provider will apply. As a result, you may be charged by your mobile provider for the cost of data for the duration of the connection while accessing the app, or other third party charges. In using the app, you are accepting responsibility for any such charges, including roaming data charges if you use the app outside of your home territory (i.e. region or country) without turning off data

Limited liability

The TOHUMAN app does not offer any medical diagnoses. In case of suspected illness, it is the sole responsibility of the user to seek competent medical attention. The TOHUMAN app only provides suggestions for healthy people and in furtherance thereof suggest alternative supplements.

The content of the app is not considered to be specific advice for the individual using the app but merely general advice based on the search criteria from the user. TOHUMAN is therefore not liable for any personal injury or damages to the user of the app.

TOHUMAN is not liable for any side effects arising from usage of third party supplements.

These supplements is in no way considered having healing effects and any such claim is fully the responsibility of the third party supplement provider and/or manufacturer.

It is at any time the responsibility of the user to be aware of possible side effects from such supplements, and to respect the suggested dosages and description of use etc. listed by the third-party supplement provider.

TOHUMAN cannot be held responsible for any suggested dosages listed in the app, as these are solely provided at the discretion of the supplement provider/manufacturer.

Data protection

TOHUMAN will store the email address, username and password entered by the user. No identifiable personal data, including inquiries performed on the TOHUMAN platform will be stored, used, or shared by TOHUMAN.

There will be no storage of data on the mobile device, to which the TOHUMAN software is downloaded, aside from the app itself.

The email address, username and password entered when using the TOHUMAN app will be stored on third-party servers (Amazon) located in Ireland. These servers seek to maintain the highest level of security.

TOHUMAN is committed to protecting the users’ information. Your password protects your user account, so you should use a unique and strong password, limit access to your computer, browser, and mobile device, and log out after having used the TOHUMAN service. While we take all reasonable data protection precautions, no security measures are completely secure, and we do not guarantee the security of user information.

The user acknowledges that TOHUMAN and its storage supplier, in their sole discretion, have taken all reasonable and necessary measures to ensure the privacy, integrity, and security of the data entered by the user. Despite these security and privacy measures, it is possible that there can be a breach in the data security resulting from non-malicious actions of TOHUMAN or storage supplier and/or malicious actions of external parties. Neither TOHUMAN nor its storage supplier shall be held responsible for such effects.

Changes to the application

TOHUMAN is committed to ensuring that the app is as useful and efficient as possible. For that reason, we reserve the right to make changes to the app at any time and for any reason.

Breach of contract

Any breach of these terms of conditions will be considered a material breach and will result in the termination of the user agreement. The user will be banned from the use of the app and from any further business dealing with TOHUMAN.

Changes to the Terms and Conditions

Occasionally, TOHUMAN may at our discretion make changes to the terms and conditions. When changes are made to these agreements, we will provide you with prominent notice as appropriate under the circumstances, e.g., by displaying a prominent notice within the app or by sending you an email. In some cases, we will notify you in advance, and your continued use of the service after the changes have been made will constitute your implicit acceptance of the changes. Therefore, please make sure you read any such notice carefully. If you do not wish to continue using the service under the new version of the Terms and conditions.

Arbitration

Any and all conflicts, including but not limited to, legal matters arising from the use or misuse of the TOHUMAN app and questions of interpretation of the above mentioned “Terms and Conditions” will be settled by the according to Danish Law and by the Institute of arbitration in Copenhagen.
